Liability Waiver
I hereby WAIVE and RELEASE all claims that I, my heirs, distributees, guardians, legal representatives, and assigns may ever have against World of Pinot Noit and/or its parent company, affiliates, subsidiaries, officers, employees, agents, sponsors, advertisers, contractors, suppliers, licensees and assigns (collectively, the “Indemnified Parties”) for injury to my person or damage to or loss of my property caused in whole or in part by the negligence or other acts or omissions of any of the foregoing Indemnified Parties, in connection with my participation in World of Pinot Noir Events taking place February 28 - March 2, 2024.
Warranting that I am in good health and of sound mind, I hereby ASSUME ALL RISKS of injury to my person and damage to or loss of my property that are inherent in my participation in the festival, whether these risks are known or unknown to me, and I hereby EXEMPT and RELEASE World of Pinot Noir and the other Indemnified Parties from any and all liability for any injury and/or damage or loss.
This RELEASE shall be governed and construed pursuant to the laws of the State of California without reference to its conflicts of laws rules. I hereby agree - with respect to any action against World of Pinot Noir and the other Indemnified Parties relating to my participation in the Event - to accept service of process by first-class mail, return receipt requested, to waive any defenses or objections based on the absence of personal jurisdiction or improper jurisdiction and venue, and that the sole and exclusive jurisdiction and venue shall be in the courts (federal and state) located in the State of California.
I have read this agreement and understand its contents. I realize that this is a RELEASE OF CLAIMS and WAIVER OF LIABILITY. I sign this contract of my own free will.
Drug and Alcohol Policy
World of Pinot Noir is concerned about the use of alcohol, illegal drugs, or controlled substances as it affects the workplace. Use of these substances, whether on or off the job, can detract from an employee or volunteers’ work performance, efficiency, safety, and health, and therefore seriously impair the employee’s value to the Organization.
In addition, the use or possession of these substances on the job constitutes a potential danger to the welfare and safety of other employees and exposes the Organization to the risks of property loss or damage, or injury to other persons. Furthermore, the use of prescription drugs and/or over-the-counter drugs also may affect an employee or volunteer’s job performance and may seriously impair the employee or volunteer’s value to the Organization.
The following rules and standards of conduct apply to all employees and volunteers either on Organization property or during the workday (including meals and rest periods). Behavior that violates Organization policy includes:
